Immediate Penalties for Impaired Driving Arrests

If a driver is arrested for impaired driving, they face immediate penalties, including:

  • Vehicle Seizure for 7 Days: Law enforcement will seize and tow the vehicle, with the owner responsible for all towing and storage fees during this period.
  • 90-Day License Suspension: Drivers will be prohibited from operating any motor vehicle on Ontario roads for 90 days. After this period, they may apply to have their license reinstated.
  • Loss of Collision Coverage: If involved in an accident while arrested for impaired driving, the driver's insurance will not cover collision damages. The insurer will cite a breach of the policy, as the driver engaged in criminal activity while operating the vehicle.

Additional costs may include towing fees, vehicle storage charges for the 7-day period, and license reinstatement fees.

Penalties Upon Impaired Driving Conviction

If convicted of impaired driving or DUI, the driver may face the following penalties:

  • Fines: First-time offenders typically incur fines around $1,000, with amounts potentially increasing based on case specifics.
  • Criminal Record: A conviction leads to a permanent criminal record.
  • Imprisonment: Jail time may be imposed based on circumstances; second-time offenders face a minimum of 30 days, while third offenses result in at least 120 days in jail.
  • License Suspensions: First-time DUI convictions result in a one-year license suspension. For second offenses, the suspension extends to three years. Third- time offenders face a lifetime prohibition, with the possibility of reinstatement after 10 years, while fourth offenses lead to a lifetime ban without the chance of regaining driving privileges.
  • Mandatory Alcohol Testing: Individuals convicted of alcohol-related offenses may be required to undergo treatment for substance abuse.
  • Ignition Interlock Device Requirement: After license reinstatement, drivers must install an ignition interlock device in their vehicle. This device performs alcohol breath tests and prevents the engine from starting if alcohol is detected.
  • Participation in the Back on Track Program: Under the Highway Traffic Act, those convicted of impaired driving or those with two or more administrative suspensions must complete Ontario’s Remedial Measures Program, known as Back on Track, prior to license reinstatement.
